Everton Faces £35m Bill to Burnley in PSR Ruling

The transfer market briefly stepped aside on Wednesday as the Premier League’s financial battleground took centre stage. Burnley have won a landmark legal fight against Everton, with an independent commission ordering the Merseyside club to pay the Clarets more than £35 million in compensation.

The ruling relates to Everton’s breach of the Premier League’s Profitability and Sustainability Rules (PSR) in the 2021-22 season, the campaign in which Burnley were relegated. In the eyes of the commission, Everton gained a sporting advantage through that breach, an advantage deemed significant enough to have contributed to Burnley’s drop into the Championship.

Everton’s response was instant – and incendiary.

Everton slam “dangerous” decision

The club issued a blistering statement, making it clear they are not only appealing but fundamentally rejecting the premise of the verdict.

“Everton Football Club is surprised and angered by the decision of a Premier League independent disciplinary commission to order a compensation payment to Burnley Football Club in relation to Everton’s PSR breach in June 2022,” the statement read.

From there, the language hardened. Everton insisted the ruling is “fundamentally flawed in both law and fact” and said they “do not recognise” the commission’s conclusion that Burnley’s relegation in May 2022 was caused by any sporting edge Everton gained from breaching PSR.

The club also pointed out that they have already served what they describe as a “substantive sporting sanction” for that breach. This compensation order, in their view, goes beyond punishment and into dangerous new territory.

“This ruling sets a dangerous and unworkable precedent for English football,” the statement continued, arguing that the decision is based on the idea that a club can be in breach of financial rules “at any point in a financial year” – a principle Everton clearly regard as unmanageable and unfair.

They maintain that the panel “misrepresents the clear evidence” put forward by their legal team and have expressed confidence that their appeal will overturn the decision.

Wider shockwaves for the Premier League

The implications stretch far beyond Goodison Park and Turf Moor. If Burnley can successfully claim compensation on the basis of another club’s financial breach affecting relegation, other clubs may look at historic seasons and ask similar questions.

Everton, though, are keen to stress that this is not a sign of current instability. They say they are “confident” of ongoing PSR compliance and have received confirmation from the Premier League that this ruling should not trigger any fresh PSR sanctions.

For supporters, the message was pointed. Evertonians, the club said, can be assured that ownership remains focused on “delivering their vision of returning Everton to the top echelon of English football.” The legal fight may rage on in the background, but the club wants the narrative to be about resurgence, not regulation.

Whether the appeal panel agrees is another matter. For now, Burnley have secured a huge financial victory. Everton have drawn a line in the sand. And the rest of the league is watching, wondering which relegation battle might be next to be dragged back into the courtroom.
